The Ministry of Education’s new proposal on legislation pertaining to the selection criteria for school administrators has drawn criticism from the Teachers Service Commission, the Kuppet union, and the Kenya National Union of Teachers.
The Basic Education Regulations of 2014 (BER) must be followed, according to the Ministry of Education’s recommendation that the Cabinet Secretary designate all heads of institutions across the country.
The teacher’s employer, on the other hand, has adamantly maintained that it is required to hire and promote all teachers. This choice has received the support of both the Kenya National Union of Teachers (Knut) and the Kenya Union of Post Primary Education Teachers (Kuppet).
Only in the event that the new concept is approved, all school principals will be required to submit fresh applications for their positions.
Furthermore, it could imply that the TSC will no longer be able to choose her own personal agent.
A new institution leader may be hired to run schools in conformity with the law if it is decided that the incumbent principals are unable to manage school resources.
Subject to the restrictions of the statutes in effect at the time, each Institutional Director shall serve a term of five years and be eligible for reappointment for two additional terms of five years each.
It has been said that while deciding whether to reappoint a teacher, consideration would be given to the performance of a candidate during the previous five years of work in the same position.

The regulations also indicate that after serving two terms of five years at the same institution, the head may be reappointed for a third term to work at another school.
Part 92 of the Basic Education Regulations 2014, which contains some of the material mentioned above, was rejected on Tuesday by Knut and KUPPET officials because they felt it unjust.
The two unions asserted that the ministry has no right to hire new employees because only the TSC is legally allowed to do so.
