Gov’t Plans to Retire Teachers and Civil Servants at the Age of 55

Teachers and civil servants will be allowed to retire at the age of 55, according to the government. If parliament approves a measure to lower the retirement age, teachers and government employees will be able to retire at the age of 55.

A public servant must retire from their position when they reach the obligatory retirement age, according to Section 80(1)(a) and (b) of the Public Service Commission Act 2017.

The mandatory retirement age is presently 60, and it is 65 for people with disabilities.

To provide more chances for young individuals in the public sector, the parliamentary committee supports lowering the mandatory retirement age from 60 to 55.

The National Assembly’s Labour Committee announced on Thursday, August 3, that it would propose an amendment to the Public Service Commission (Amendment) Bill, 2023 that would raise the retirement age to 55.

Benjamin Gathiru, MP for Embakasi Central, is the bill’s sponsor. It also proposes to change the present Act such that no officer can serve in an acting capacity for more than six months.

Fabian Muli, a Kangundo member of parliament, suggested that if the committee wants to represent the interests of the youth, it should submit additional Bill modifications that lower the retirement age.

Mr. Muli remarked that in order to build pride in the nation’s young people, “we need to think further and lower the age to 55.”

He went on to say that if the committee did not consider the age reduction modification, he would personally propose it.

The committee, according to Kilifi South MP Ken Chonga, must change the underlying legal parameters governing retirement age.

Mr. Chonga believes that in order to change those laws, we must first understand how the 60-year retirement age was determined.

Mangale Munga, MP for Lunga Lunga, stated that there is a need to accommodate the increase of young people while supporting the reduced retirement age.

What’s the point of six decades? It should be raised to 55 years old to make room for younger individuals. According to Mr. Munga, that is a proposal; whether it is accepted or rejected is a question of personal preference.

“I have allowed the committee to make changes to the Bill,” Mr. Gathiru said, “but we must not lose sight of its purpose or objective.”

If the amendments are approved, the majority of government employees who are scheduled to retire within the next five years will be able to do so sooner. This will have serious ramifications, including putting more financial strain on a government that is already failing to meet its obligations due to higher pension payments.

As a result of the government’s struggles to meet rising pension costs, the required retirement age was raised from 55 to 60 in 2009.

In the six months running up to December 2021, the National Treasury distributed Sh69.22 billion in pension and gratuity payments.

According to a 2016 audit, 35% of national government employees were between the ages of 51 and 60.

According to the annual report of the Public Service Commission (PSC) covering 47 ministries, agencies, and organizations, 3,958 officers left the service in Fiscal Year 2021-2022.

Under the Public Service Commission (Amendment) Bill, 2023, a person may be appointed in an acting capacity for up to six months, but no more than 30 days.

According to the proposed legislation, an individual can only be nominated to serve in an acting capacity in a public office if they meet all of the requirements for that particular officer.

According to the legislation, “an acting appointment shall be made in favor of a public officer who is duly qualified and competent to perform the duty and shall not jeopardize the expeditious appointment or deployment of a competent person to the public office concerned.”

If someone is appointed to an acting role without the necessary credentials, the Public Service Commission will promptly terminate the appointment.
