Procedures for TSC’s Salary Overpayment Recovery Strategy
When it comes to carrying out the duties of the Teachers Service Commission in managing teachers within the educational system, financial management is frequently a crucial component.
The Commission places a high value on honesty, responsibility, and high ethical standards in the performance of responsibilities and the reporting of any erroneous payments or changes that result in excessive salary payments in the teaching profession.
When a teacher learns that the Commission overpaid them, it is the Commission’s job to decide the best course of action for recovering the money and dealing with the fallout.
In order to recoup overpaid cash from teachers who don’t voice their concerns, the employer of instructors will use a variety of tactics.
Methods for Recovering TSC Overpayments:
- The Commission ensures that each employee keeps one-third of their basic salary as net compensation by recovering at least one-third of the basic salary from each employee on the payroll.
- TSC recovers all owed overpayments from salary arrears and any lingering amount via payroll.
- TSC may alter the rate of salary overpayment recovery by pay raises or compensation modifications.
- When an overpayment is found, TSC sends a demand letter to the employee to inform them of the situation.
- TSC starts legal action to recoup overpaid salaries from departing staff.
- TSC may suggest write-off for any overpayments that section 157 of the Public Finance Management Act, 2015 deems to be unrecoverable.
The Commission Secretary must be satisfied of the following before TSC can recover salary overpayments:
- Although reasonable efforts were made to recover the damages, it was not possible to do so.
- It would be inefficient to make additional attempts to recoup the loss.
- The Commission has a financial incentive to resolve or waive the claim.

If a TSC employee who is responsible for the overpayment departs the company before full recovery, the remaining balance becomes payable and must be settled in accordance with legal requirements.
When it comes to criminal proceedings:
Any person found responsible for an overpayment or discovered to have failed to report one shall be reported to state agencies and other institutions and subject to any required criminal procedures. This situation is regarded as criminal.
