Teachers who are acting will soon be paid an acting allowance
Teachers and government employees who act as administrators will now be compensated for their time. For extended periods of time without formal confirmation or pay, teachers have held administrative roles (such as Senior Teachers, Senior Masters, Deputy Headteachers, Deputy Principals, Headteachers, Senior Headteachers, Principals, and Senior Principals).
However, a recent development provides comfort to individuals who have filled these posts for more than six months because MPs rejected a bill that would have denied allowances. In accordance with the Constitution and Employment Act, this proposition was deemed unfair and discriminatory.
The bill was rejected by the National Assembly Labour Committee on the grounds that it would result in unfair labor practices and violate Article 27 of the Constitution, which guarantees equality before the law and prohibits discrimination. They stressed that equal pay for equal work is required by the Employment Act.

The committee suggested that an officer be allowed to act for up to 12 months before the job is declared vacant and competitively filled, as opposed to the six months that were originally proposed. Individuals won’t be eligible for acting allowances after this time frame.
The bill’s proponent, Embakasi Central MP Benjamin, argued that companies should have officers with comparable skills ready to take over rather than having someone serve in an acting capacity for longer than six months because it is known when teachers and civil workers will retire.
The Public Service Commission (PSC), however, objected to the revision, citing a number of situations, such as officials on secondment or those on extended vacation, that prevented all acting positions from being filled immediately. They emphasized that the continuity of service delivery is ensured by the appointment of officers to acting positions.
Although there are provisions for acting roles under the Employment Act and the Public Service Commission Act, some officers, particularly in parastatals, wind up serving in acting roles for lengthy periods of time, often up to three years.
