Teachers from Taita Taveta claim that without their permission, the Kenya Women Teachers’ Association (KEWOTA) and the Teachers Service Commission deducted Sh200 per month from their pay as a subscription fee.
Over 171 county-based female teachers who are among the 80,000 association members have petitioned for an investigation and an end to the deductions through Taita Taveta Senator Johnes Mwaruma.
“TSC committed an economic crime by colluding with KEWOTA to unlawfully deduct Sh200 from teachers as members of KEWOTA without their consent since 2019,” the suit claims.
“The petitioners request that the deductions cease immediately and that all money withheld be immediately refunded with accruing interest,” reads the petition.
Mwaruma asserted that the affected teachers had been requesting the deduction be stopped in writing to their employers in vain.
“In some cases, the deduction was temporarily halted before it was resumed. Teachers have a right not to be taken advantage of by their employers, and the members have tried vainly to have the issue handled, he added.
Nancy Macharia, the TSC CEO, did not return our calls or messages by the time the story was published, so we were unable to get a response from her.
Benter Opande, CEO of KEWOTA, however, expressed regret that certain union leaders were going about compelling teachers to sign petitions against their choice.
“Our organization has never received these complaints. As required by law, not a single letter has been delivered to our office. Therefore, these claims are unrelated to KEWOTA, Opande added.
The petition comes after the teachers wrote another letter to the EACC requesting that it open an investigation into the situation.
The letter the agency received on April 24 states that the deduction is not shown on the instructors’ pay stubs “to protect the KEWOTA from teachers’ legal action.”
